1. Agreement to Terms

By accessing or using Detekta ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

Detekta provides AI-powered tools to assist GCC financial institutions with regulatory breach reporting. Our services include:

• AI-assisted breach report generation
• Regulatory compliance guidance
• GCC regulatory knowledge base
• Prompt library for compliance workflows

Important: Detekta is a tool to assist compliance professionals. All AI-generated outputs require human review and approval before submission to regulatory authorities. Detekta does not provide legal advice.

3. Early Access Program

3.1 Beta Status

The Service is provided as a beta/early access product. Features may be incomplete, change without notice, or be discontinued. We make no guarantees regarding availability, reliability, or functionality during the early access period.

3.2 No Service Level Agreement

During the early access period, we do not provide Service Level Agreements (SLAs) for uptime, response times, or support. We will make reasonable efforts to maintain service availability but cannot guarantee uninterrupted access.

3.3 Feedback

As an early access participant, you may provide feedback, suggestions, or bug reports. You grant Detekta a perpetual, royalty-free license to use such feedback to improve our Service.

4. User Responsibilities

You agree to:

• Provide accurate account information
• Maintain the confidentiality of your login credentials
• Review all AI-generated content before use or submission
• Use the Service only for lawful purposes
• Comply with all applicable laws and regulations
• Not attempt to reverse engineer, copy, or redistribute the Service
• Not use the Service to process data you are not authorized to handle

5. Intellectual Property

5.1 Our Property

The Service, including its design, features, content, and underlying technology, is owned by Detekta and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

5.2 Your Content

You retain ownership of data and content you submit to the Service. You grant Detekta a limited license to process your content solely to provide the Service. We do not use your content to train AI models.

6. Disclaimers

6.1 No Legal Advice

Detekta provides compliance assistance tools, not legal advice. AI-generated content is for informational purposes only. You should consult qualified legal and compliance professionals for regulatory matters.

6.2 AI Limitations

AI-generated content may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing, verifying, and approving all outputs before use. Detekta is not liable for decisions made based on AI-generated content.

6.3 As-Is Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Detekta shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Detekta's total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim, or USD 100 if no payment was made.
• Detekta is not liable for regulatory fines, penalties, or enforcement actions resulting from your use of the Service.

8. Indemnification

You agree to indemnify and hold harmless Detekta, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

Either party may terminate this agreement at any time during the early access period. Upon termination:

• Your access to the Service will be revoked
• You may request export of your data within 30 days
• We will delete your data in accordance with our Privacy Policy

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
